Before you enter the site PENATIS.com (hereinafter referred to as the “Site”), please, read the Customer Agreement (hereinafter referred to as the “Agreement”).
Implementing the login using PENATIS.com, you agree to the following terms and conditions of the Agreement. In case you do not agree to these terms, do not use this site PENATIS.com.
1. Agreement Acceptance
You agree that entering any page of the site PENATIS.com, you conclude the Agreement and become a user (hereinafter referred as to the “User”) of the site PENATIS.com. You are provided with the Site under the conditions set forth in the Agreement and the supplements. The Customer Agreement may be amended from time to time and published without advance notice. You should review the Agreement each time you enter the Site to learn the changes. In case the User disagrees with the amendments, he is to refuse entering the Site, is to stop using the materials and services of the Site. On the Site you will be able to obtain the information about the definite products and services. In addition, you can send your queries onto PENATIS.com for obtaining more information. Please, note that the Site is all European, and that the products, services, and etc. available in different countries may vary. Use the appropriate links and other applications for more information on the products and services available.
You agree that in order to have the right to use the Services, you meet the following criteria, and guarantee that you, including but not limited to, have come of age; nothing prevents you to use the Services; you are not a competitor of PENATIS.com, and do not use the Services for the purposes of the competition with the Site; you have the full power and authority to enter the Agreement, and it will not be violation of any other agreement concluded by you. You agree at your own expense provide all the equipment, software, and other provision, and the Internet access required for you to use the Services.
The Site also allows the users to register and create accounts, and then the User has the opportunity to access the “My Account”. In the latter the user can place the information about the company he represents, including, but not limited to: the information about the services, goods, work, etc., provided, the contact information, other information that is not prohibited by the law and/or the Agreement.
PENATIS.com administration notes that they reserve the unconditional right at their sole discretion to refuse the User in providing the latter with registration, account creation, etc., as well as the right to remove the information and/or disable the access to the information on the Site without notice or explanation of reasons. PENATIS.com administration is not responsible for any inaccuracies, errors, omissions made by you during the registration and/or location the information, as well as for any material and/or immaterial damages in this regard.
3. Services Cost and Payment
The appropriate services are provided for the fee the amount of which is set by the administration of PENATIS.com under the conditions specified here.
If you purchase the Services, you agree that the administration of PENATIS.com save your data used. You are to make payments for the Services rendered within the necessary terms and to pay all the appropriate taxes and fees, and to reimburse to the Site the full cost of the collection of overdue payments and/or interests on them.
4. Use of the site PENATIS.com
You guarantee that you are the owner of the information provided by you to the site PENATIS.com. You can request its removal, except when you published the information or assigned it to others, and others did not delete it, or copy or save it. 3) one that violates the property rights of any third person or persons in respect of which you have not obtained all the necessary licenses and/or sanctions;
4) violating any applicable laws, agreements, and other add-ons.
You agree not to transfer or send by means of the Site any information that could reasonably be considered as constituting or encouraging conduct that can be considered as a criminal offense, as involving the civil or other liability, or as contradicting the laws of Ukraine, any country or other competent authority, or as violating the rights of any third party which are ensured with legal protection in any country of the world.
The administration of PENATIS.com reserves the unconditional right to remove any information from the Site, if there are reasonable grounds to suspect that such information is prohibited by the provisions of the Agreement or is unacceptable for other reasons. Notwithstanding the above said, you acknowledge that the administration of PENATIS.com does not control the information content of the Site provided by other users, and does not intend to monitor the information content of the Site as for its accuracy, appropriateness or conformity with the principles of the Agreement.
You are not to connect through links PENATIS.com site with any other web sites of obscene or inappropriate content, and you are to remove any links at the request and at the discretion of the administration of PENATIS.com. You are not to take actions that may affect the normal operation of the Site.
All the information (including but not limited to, texts, images, audio files, graphics, images, music, videos, digital downloads, software, etc.) contained on the Site is the property of their owners and/or its suppliers, and is protected by the Ukrainian, European and international legislation on copyright and other rights.
You are to use the information of the Site in accordance with the Agreement. Any use of the information on any other web site or networked computer environment for any purposes is prohibited. If you want to use the Site information for any purposes other than the permitted ones by the Agreement, you must obtain prior consent from the owners of the respective copyright and/or licensors of these materials. You agree that you may not assign or transfer any rights or obligations under the Agreement. Any possible transfer or assignment will have no legal force. The Site administration may assign or transfer any rights or obligations under the Agreement, in whole or in part, without notifying you.
You agree to defend PENATIS.com from any claims, demands, losses or damages being the result of the breach of the law, the Agreement, and other applications. You are to indemnify to PENATIS.com and hold harmless the Site from liability for any damages, losses and expenses in connection with any claims, charges or investigations of third parties.
5. Limitation of Liability
The website administration of PENATIS.com hereby excludes all the possible conditions, warranties, representations and other terms relating to the provision or implied provision, failure to provide or delay in providing any services related to the Website as well as the accuracy, completeness or currency of the information on the Site which might arise between you and the administration of PENATIS.com or otherwise be included into the Agreement or any contracts on the basis of their provisions, common law or otherwise.
